There are two main types of judicial firearm rights restorations in Minnesota.
Felony “Crime of Violence” Conviction Restoration
The first type of judicial restoration of firearm rights is for people convicted of a felony “crime of violence.” (Minn. Stat. Sec. 609.165, subd. 1d) Felony “crime(s) of violence” include felony-level controlled substance crime convictions, felony-level assault convictions, and first and second-degree burglary convictions, in addition to multiple other types of felony convictions.
Civil Commitment Restoration
The second type of judicial firearm rights restoration for a person who was judicially committed to a treatment facility who is mentally ill, developmentally disabled, or mentally ill and dangerous to the public as defined by law (Minn. Stat. Sec. 624.713, subd. 4).
Pardon
There is also a non-judicial option for firearm rights restoration under Minnesota’s pardon law. (Minn. Stat. Sec. 638.12) A pardon may be an option for people convicted of a misdemeanor “crime of domestic violence”, a felony “crime of violence” conviction, and a non-“crime of violence” felony conviction.
